A. SERVICE FEE: The service fee covers the initial exterior inspection, setting trap(s), trap(s) retainer, repair estimate and keeping the traps baited during the retainer period. This fee shall be paid in full and placed at the front door of the owners dwelling in the envelope provided or mailed by Naps Happen LLC second trip. In the event that payment is not made and no other payment arrangements have been made, Naps Happen LLC will remove any trap(s) and animal(s) captured upon the second trip and the owner will be responsible for these fees. The service fee is non-negotiable.
B. PRICE PER ANIMAL CAPTURED FEE: The price per animal captured fee covers the cost of disposing or relocating the stated animal(s) according to law and trap maintenance. The price per animal captured fee is non-negotiable.
C. NON-TARGET ANIMAL CAPTURED FEE: The price per non-target animal fee covers the cost of releasing the stated animal(s) on the owners stated property, disposing or relocating the stated animal(s) and trap maintenance. The law states that non-target animals must be released on the owner’s property, unless the owner would like those animals disposed of or relocated according to law. The price per non-target animal captured fee is non-negotiable and applies to animals released on the owners stated property.
D. RECOMMENDED REPAIRS, EXCLUSION OR CLEAN UP: Naps Happen LLC only recommends the repairs, exclusion or clean up that are necessary in order to prevent future wildlife damage. The price for each individual repair, exclusion or clean up are non-negotiable. However, the owner may cross out any of the individual recommendations that he / she may not want performed and recalculate the total repair estimate. (Please initial any changes to the recommendations.)
Naps Happen LLC may not be able to see or find all damages incurred because of the stated animal(s) and Naps Happen LLC is not responsible for these damages.
E. ACCESS: The owner shall permit Naps Happen LLC, their agents and employee’s free ingress and egress to the owner’s premises with all necessary materials and equipment at reasonable times for the performance of the service to be rendered under this contract. Further, the owner shall vacate the premises for periods required and as directed by COMPANY if necessary.
F. FINES: In the event that any outstanding balance remains due to Naps Happen LLC after the due date on the final invoice, the owner agrees to pay a finance charge on said outstanding balances at the rate of 2% per month. The owner shall also be responsible for $25 fee plus bank charges to Naps Happen LLC for any checks returned by a bank for non-sufficient or any other reason. In addition, the owner agrees to pay for all collection costs, including the cost of reasonable attorney’s fees, on any outstanding balance due under this service agreement contract.
G. CHECKING TRAPS: As required by law, all traps must be checked daily. Therefore the owner agrees that he / she will check the traps daily and will notify Naps Happen LLC when an animal is trapped. If the owner is not able to check the traps daily, they must notify Naps Happen LLC immediately and arrangements will be made by Naps Happen LLC to check the traps daily for the owner for an additional service fee.
II. Naps Happen LLC OBLIGATIONS:
A. RETAINER: The retainer is the period of time, based on average, that it takes to capture the stated animal(s). Naps Happen LLC will maintain the traps in the time period stated. In the event that the stated animal(s) has not been captured or is no longer creating damage, problems or seen the traps will be removed at the end of the retainer time. (If stated animal returns. See service warranty) In the event that the retainer time period ends and the stated animal(s) are still creating damage, problems or seen Naps Happen LLC will extend the retainer period as long as needed to capture the stated animal(s) at no additional service fee to the owner.
B. LICENSES: Naps Happen LLC is a state licensed contractor. All of the full-time Naps Happen LLC employees are Commercial Nuisance Animal Permit holders through the Enter Your State’s Regulatory Agency (if appropriate).
C. WORKMANSHIP: Naps Happen LLC, their agents and employees will render the service in a good workmanlike manner according to the customary and approved methods and procedures prevailing in the business of Wildlife Management. Naps Happen LLC agrees to exercise the greatest care in trapping said animal(s) to avoid damage to the owner’s property.
D. ANIMAL DISPOSITION: Said animal(s) shall either be released on the land of the owner or shall be disposed of by Naps Happen LLC according to the law of the Enter Your State’s Regulatory Agency (if appropriate).. Said animal(s) will be removed from the owners property according to law. Any non-target animals will be released on the owners property, unless other arrangements have been made by the owner and Naps Happen LLC.
III. WARRANTIES:
A. SERVICE FEE LIMITED WARRANTY: The service fee limited warranty is the stated time period in which Naps Happen LLC will return to the owners premise and inspect, re-set trap(s), trap(s) retainer, repair estimate and keeping the traps baited during the retainer period. This warranty does not include the price per animal captured fee. This warranty is void in the event that recommended repairs, exclusion or clean up are needed in order to prevent future damage or problems and the owner does not hire Naps Happen LLC to perform such recommendations. The service fee limited warranty can only be used on said animal(s) in this service agreement contract.
B. REPAIR LIMITED WARRANTY: If Naps Happen LLC is hired to perform the recommended repairs, exclusion or clean up and the stated animal(s) enter through these repairs, Naps Happen LLC will return the owners premise and re-set trap(s), trap(s) retainer, keep the traps baited during the retainer period and re-repair the old repair stated in the warranty time period at no additional cost to the owner. The repair limited warranty is limited to the repairs recommended and hired to perform by Naps Happen LLC. In the event that the stated animal(s) enter through any area(s) not needed for repair or found by Naps Happen LLC a service fee may be charged to the owner and a price per animal captured fee will be charged to the owner.
This is not a guarantee that the stated or any animal(s) will not enter or damage your home and Naps Happen LLC is not liable for these damages.
C. OPTIONAL ANNUAL SERVICE WARRANTY: The Owner has the option to extend the service warranty on an annual basis for an additional stated fee. In the event that the Owner is in need of Naps Happen LLC services within this warranty, Naps Happen LLC will return to the Owners premise and inspect, re-set trap(s), trap(s) retainer, keep the trap(s) baited and remove stated animal(s) at no additional cost.
This is not a repair or damage warranty. This warranty will extend any stated recommended repair limited warranties by Naps Happen LLC that are less than a year up to a year. In the event that the stated animal(s) enter through any area not warranted by Naps Happen LLC, a repair fee may be charged to the Owner and that repair will be added to the current warranty.
This is not a guarantee that the stated or any animal(s) will not enter or damage your home and Naps Happen LLC is not liable for these damages.
This optional annual service warranty may not be an option in certain circumstances and Naps Happen LLC reserves the right not to offer this warranty. Naps Happen LLC reserves the right to not renew this annual service warranty.
Upon your annual renewal payment Naps Happen LLC will re-inspect your home to ensure your protection against stated animal(s).
IV. DISCLAIMERS:
The process used in eradicating the said animal(s) involves equipment that may be hazardous to human beings and animals. Therefore, Naps Happen LLC disclaims any responsibility for any injuries or damage that may occur to any person(s) or animal(s) as a result of such trap(s) and/or equipment being used.
Further, the trap(s) themselves and any animal(s) caught in said trap(s) may be hazardous to any person(s) or animal(s) who may get too close to said trap(s) or captured animal(s). Therefore, the owner understands and agrees that Naps Happen LLC will not be responsible for any injuries to any person(s) or animal(s) or for any damages resulting from any person(s) or animal(s) coming too close to said trap(s), whether said trap(s), is empty or whether there is an animal(s) trapped therein.
Any animal(s) may cause damage to the premises or cause injury to person(s) or animal(s) prior to being trapped or after being released on the owners property. It is possible, but unlikely, that the trapped animal(s) may escape from said trap(s). Any animal(s) caught in said trap(s) may damage or contaminate the area around and underneath said trap. It is also possible, but unlikely, that the animal(s) may also escape while being removed from the premises by Naps Happen LLC. Therefore, the owner understands and agrees that Naps Happen LLC will not be responsible for any injuries to person(s) or animal(s) or damage caused by said animal(s) while on the owner’s premises.
As there may be more than one animal and/or other causes regarding the owner’s complaints, COMPANY does not guarantee that all animals and/or animal carcasses have been found and/or removed, or that the cause of the owner’s complaint has been rectified.
As Naps Happen LLC is in the business of handling animal problems, the owner understands and agrees that Naps Happen LLC is not responsible for disclosing any damage that may have been caused by any animal, nor is Naps Happen LLC liable for any damage caused by any animal.
V. RIGHT TO REMOVE TRAPS:
Naps Happen LLC reserves the right to remove any traps from the owner’s premise at any time due to public resistance and the owner will be responsible for any fees up until that time.
Naps Happen LLC also reserves the right to remove any trap(s) from the owner’s premise if Naps Happen LLC has any reason to believe that the owner is tampering with the trap(s) or any animal(s) in the trap(s) and the owner will be responsible for any fees up until that time.
Naps Happen LLC also reserves the right to remove any trap(s) in the event that the service fee payment has not been paid and the owner will be responsible for any fees up until that time.
VI. STOLEN TRAPS:
The owner is responsible for the trap(s) set on the owners said property and Naps Happen LLC reserves the right to charge the owner a trap(s) replacement fee for any trap(s) stolen on the owners said property.
In the event that the owner feels like the trap(s)s are set in an area that may be at risk on said property to be stolen they must notify Naps Happen LLC of this risk the day that the trap(s)s are set.
If Naps Happen LLC wishes to keep the trap(s) set in this area of risk to be stolen, than the trap(s) become Naps Happen LLC responsibility and the owner will not be charged a trap replacement fee if the trap(s) are stolen.
